Q: Can a person with AIDS get married?
As-Salaamu aleykum What is the Islamic ruling for a person with AIDS getting married? What limits and conditions, if any? Also, what would be the criteria for other diseases and their relationship to getting married, or even being married? Jazakum Allahu khayran
All Praise be to Allah
The person who has AIDS must tell his potential or current wife immediately. The potential wife may decline the proposal and the current is entitled to termination if she wishes.
This is not out of prejudice, for not everyone acquired the disease because of an immoral lifestyle. Moreover, those who did, and thereafter repented, are not to be blamed for a sin they repented from. This ruling is rather because of the Prophets statement:
“لا ضَرَرَ ولا ضِرَارَ.”
There shall be neither harm nor reciprocation of harm.
If the other party is willing to carry on with the marriage plans or stay in the marriage, then every possible effort must be done to keep them safe. For details, the person should consult a physician.
